Trump administration asks appeals court to allow National Guard deployment in Portland

The Trump administration says a federal judge’s ruling blocking the deployment of the National Guard in Portland should be put on hold while appeals are pending.
“Congress did not … authorize the federal courts to second-guess the President’s judgment about when and where to call up the Guard to reinforce the regular forces in response to sustained and widespread violent resistance to federal law enforcement,” Assistant Attorney General Brett Shumate said in a court filing Monday.
Judge Karin Immergut – a first-term Trump appointee – ruled over the weekend that the government’s claim that the Guard was needed to calm long-running protests outside an Immigration and Customs Enforcement building in Portland was “simply untethered to the facts.”
The Circuit Court has not yet responded to the federal government’s request.
